Terms and Conditions of Membership in Nestham Matrimony

Welcome to Nestham Matrimony. This document is an electronic record under the Information Technology Act, 2000 and applicable rules relating to electronic records. It is generated by a computer system and does not require physical or digital signatures.

This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, which require publishing the rules, privacy policy, and terms for access or use of this platform.

Please read these terms carefully before using the website or app. Accessing, browsing, or using the platform means you agree to be bound by this Agreement. If you do not agree, you must not use Nestham Matrimony or its services. These terms incorporate our applicable policies, including our Privacy Policy, as amended from time to time.

In these terms, "member", "you", and "user" mean any person accessing Nestham Matrimony, including a parent, relative, or friend registering on behalf of a prospective bride or groom. "Services" means matrimonial services offered through Nestham Matrimony.

Scope

You understand that Nestham Matrimonyacts as an "Intermediary" under Section 2(1)(w) of the Information Technology Act, 2000. The platform enables users to register voluntarily, search profiles from existing registered members, and seek lawful matrimonial alliances.

Members may receive free or paid access to search profiles based on partner preferences set by them. Profiles are organised to help members discover suitable matches conveniently. Registration requires a valid mobile number and email address.

1. Eligibility

Membership is reserved for:

• Indian nationals and citizens;
• Persons of Indian origin (PIO);
• Non-resident Indians (NRI); and
• Persons of Indian descent or heritage.

By registering, you confirm that you are:

• at least 18 years of age if you are a woman, or 21 years if you are a man;
• legally competent to marry under applicable law, including Indian law where relevant; and
• registering with a genuine intention of marriage, not for commercial or unlawful use.

If you register on behalf of another person, you confirm that you have their consent to create and manage the profile.

2. Registration

You agree to provide true, accurate, current, and complete information during registration, including recent photographs. Enter details only in the relevant fields and do not repeat information unnecessarily or mention other platform IDs in profile fields.

If we find that any information or photograph is false, misleading, incomplete, or inappropriate, we may suspend or terminate your membership without notice and refuse further service.

Duplicate profiles for the same person are not permitted. Organisations, agencies, or persons running similar or competing businesses may not register or use member data for commercial purposes.

Synthetically generated information (SGI): You must not upload AI-generated, manipulated, or synthetic photos, audio, or video content, including deepfakes. We may use reasonable technical measures to detect such content and remove it. Content that impersonates others, is deceptive, unlawful, or harmful may be removed and may lead to account suspension.

3. Account security

You are responsible for safeguarding your login credentials, including user ID, password, and OTP. We will never ask for your password. You are responsible for all activity under your account and should restrict access to your devices.

4. Role and responsibility of Nestham Matrimony

• We display profile information on an "as is, as available" basis to help members search prospects themselves.
• Match suggestions are generated automatically based on preferences you set. Changing preferences may change results.
• We do not guarantee any specific matrimonial outcome from use of the service.
• We use reasonable security standards to protect sensitive information, but cannot guarantee complete protection of data in transit.
• We do not authenticate or endorse every detail in a profile. Members must verify information independently.
• If you delete your profile, our obligations under this agreement end with respect to that account.

5. Role and responsibility of members

• Use a strong password and keep your profile information updated.
• Verify prospect details such as marital status, education, employment, and health information before making decisions.
• Upload recent photographs only. Old, third-party, or AI-generated photos may lead to suspension.
• Disclose relevant health information honestly during profile creation where applicable.
• Do not seek or offer money to prospects, use abusive language, share bank details recklessly, harass others, or violate applicable law.
• Be cautious of prospects who avoid family involvement, refuse reasonable verification, or request financial favours.
• Delete or request deletion of your profile once your matrimonial search concludes successfully.
• Do not use bots, scripts, or automated tools to access or interact on the platform.
• Make payments only through official Nestham Matrimony channels, not to individual staff.

7. Medium of communication

You consent to receive service-related and promotional communications by email, SMS, phone, or WhatsApp where permitted by law. You may adjust communication preferences in your account settings where available.

8. Confidentiality of feedback

Feedback you provide may be used by us without restriction or compensation, provided it does not include confidential third-party information you are not entitled to share.

9. Privacy of membership

Please read our Privacy Policy, which explains how we collect, use, and protect personal information. If you object to our data practices, please do not use the platform.

10. Disputes between members

Members are solely responsible for communications and interactions with prospects. We are not responsible for financial transactions, meetings, calls, messages, or outcomes between members and are not a party to private disputes.

11. Content rights

You are responsible for content you submit, including profile details, photos, and messages. You confirm that you have the right to share such content. By submitting content, you grant us a licence to use it for operating, promoting, and improving the service, and for lawful compliance purposes.

If your content violates these terms, we may remove it or suspend your account. We may also restrict communications where necessary to protect members.

12. Third-party services

The platform may display third-party advertisements or links. We do not control third-party websites and are not responsible for their content, terms, or privacy practices. Use third-party services at your own risk.

We may add, modify, suspend, or remove features at any time to improve the service.

13. Limitation of liability

To the fullest extent permitted by law, Nestham Matrimony and its operators shall not be liable for indirect, incidental, special, or consequential damages arising from use of the website, app, or services.

Profile exchange through the platform does not constitute a matrimonial guarantee or recommendation. Our liability, where applicable, is limited to the amount paid by you for the specific paid package giving rise to the claim.

We are not liable for wrong matches, non-response by other members, financial dealings between members, technical failures, force majeure events, cyber incidents, or issues arising from inaccurate information submitted by users.

14. Class action waiver

You agree not to bring or participate in class actions or class proceedings against Nestham Matrimony. Neither you nor we agree to class arbitration.

15. Misuse and enforcement

False complaints, impersonation, harassment, unlawful content, or misuse of the platform may result in suspension, deletion, legal action, and forfeiture of fees where permitted by law. We may remove content that is offensive, unlawful, infringing, or harmful to members or staff.

16. Paid membership and contact visibility

When a paid membership expires, premium benefits such as viewing contact numbers or email addresses may stop automatically. Previously accessed contact details may no longer remain available unless you renew within any grace period shown in your account.

17. Disclaimer

The service is provided on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not guarantee marriage or alliance as a result of registration or use of free or paid services.

Your use of the platform is at your sole risk.

18. Indemnity

You agree to defend and indemnify Nestham Matrimony and its operators against claims, losses, or expenses arising from your misuse of the service or breach of these terms.

19. Termination

We may suspend or terminate your account if you violate these terms, provide false information, impersonate another person, seek improper favours, or misuse the platform. You may also request account closure subject to applicable notice and policy rules.

Upon termination, your right to access the service ends immediately. Provisions that by nature should survive termination will continue to apply.

20. Jurisdiction and applicable law

These terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of competent courts in Rajahmundry, Andhra Pradesh, India, unless otherwise required by mandatory law.

21. Mode of payment

Payments may be made through approved methods such as UPI, net banking, debit card, credit card, or other gateways supported on the platform, in accordance with applicable RBI guidelines. Activation of paid services depends on successful payment realization.

Where required by law, you may need to provide tax-related information for higher-value transactions. Payment partners may receive limited information needed to process transactions securely.

22. Refund and assignment

Membership fees and renewal payments are generally non-refundable unless expressly stated in a specific offer. You may not transfer or assign your membership to another person. Payments made for one package cannot be adjusted against another without our written approval.

23. Terms for non-resident Indian (NRI) users

NRI users agree that Indian law applies to use of the platform. Parties should first attempt to resolve disputes informally. If unresolved within 30 days, disputes may be referred to individual arbitration under the Arbitration and Conciliation Act, 1996, with seat at Rajahmundry, Andhra Pradesh, India, in English.

24. Child safety standard

• The platform is intended only for individuals aged 18 and above.
• Content that exploits, endangers, or sexualises children is strictly prohibited and may lead to immediate account termination.
• We take reasonable steps to prevent unlawful child-related content and act on valid reports in accordance with applicable law.
• Concerns may be reported to nesthammatrimony@gmail.com or through the National Cyber Crime Reporting Portal at cybercrime.gov.in.
